Medical Malpractice Reform, Healthcare, and Congress
With Medical Malpractice Reform in Healthcare: American citizens win, The Federal Budget wins, Insurance businesses win, and Physicians win.
The CBO reports an estimated $54 Billion in federal budget savings over the first 10 years with increases in savings snowballing with each successive year if medical malpractice reform is passed.
Although their estimates represent excellent savings, the CBO estimate could easily be well below actual based upon two facts: -
CBO estimate addresses "federal budget savings" and does not include corresponding approximate $82 Billion in personal savings to the under 65, non-Medicare, American citizens. (Based upon the fact that there are twice as many 18-64 yr olds than under 65 government workers plus 65 and up persons according toWikipedia and Population Reference Bureau.

CBO has a long history of underestimating costs by significant percentages, so a reasonable assumption would be that they are likely underestimating medical malpractice reform savings similarly.)
Who could possibly be against medical malpractice reform anyway?
The malpractice reform the CBO analyzed still provides -
Complete present and future economic damages including medical and loss of wages

Non-economic "pain and suffering" of $250,000

Punitive damages of $500,000 or twice economic damages to the plaintiff (whichever is greater).
We are still talking about million dollar payoffs here. The main thing the reform curtails are "lottery" type payoffs.
Clearly, normal people aren’t championing the big lawyer and "lottery winner" payouts since we all finance them with increased healthcare costs.
The champions of this status quo are the trial lawyers.
No, it is not all the former lawyers who support lottery payouts as might be expected. Data analysis indicates that former occupation has almost no effect on medical malpractice reform voting.
The trial lawyers outside of Congress are actually the ones controlling the voting and blocking malpractice reform that would reduce healthcare costs to all Americans.
How?
90% of Trial Attorney lobby campaign donations went to Democrats and 99% of Class Action Trial Attorney donations went to Democrats. Predictably, Democrats in both the House and Senate then vote as instructed by their financers in order to protect their re-election money supply.
